August 5, 1804 -- letter from John Lewis in Covington to James McDowell in Rockbridge County, Virginia
Covi. 5th August 1804
When you went last to Kentucky you were kind enough to take a Bond on Christian ---- of Lexington to collect for me which Bond you thought proper to put in the hands of Mr. Hart. I have lately Kuirs? A letter from Mr. Hart informing me of the result of the suit which Mr. Hart thought proper to commence. Kuirs has abtained an injunction which requires an immediate answer from your letter to me from Rockbridge of January 11th 1802. I had no expectation of Kiser resquing a law suit. I think your affidavit will be of service, and will quote your letter to me on the subject, which will perhaps assist your memory. "Dear Sir I presented the Bond on Christian ---- for payment he told me he could not pay before March next at which time because he had been unlucky with the negro. I told him I would place the Bond in the hands of Mr. Hart, who would be governed by your directions after I had communicated to you what had taken place. You see sir I have not fully complied with your directions about the Bond. The reason I did not put it into the hands of an Attorney as you wished I was informed you might depend on the money being paid on the day now fixed." ---- this above is all which your letter contained respecting that business you will ablidge me by having your deposition taken on the above subject and enclose it in a letter to Mr. Hart of Kentucky, which will be the speediest way of conveyence. I am advised your deposition will be of service as Kiser made no objections of paying at that time had he been provided and ---- the indulgence you above stated. I should have went to see you but I have to go to see Mr. William Preston on the same business before I can answer his bill of Injunction, which will be necessary to forward to Mr. Hart against September next you see my friend the trouble we have in this World suppose we get on the other side of it and lay the foundation of a Federal City at the mouth of the River of the West. As Gwinn says your thoughts on this I crave I with my best respects to your family. I am Dear Sir your friend.
